Our shopping cart was developed using world leading shopping cart template manufacturers. It is also important for you to protect yourself against unauthorized access to your password and to your computer. SALE OF BUSINESS

If the business is sold or integrated with another business, your details may be disclosed to our advisers, any prospective purchaser and their advisers and will be passed on to the new owners of the business. However, we will protect your privacy as earlier provided in our privacy policy.

You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address and/or physical address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. ICT Cart reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant ICT Cart a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant ICT Cart and sub-licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify ICT Cart for all claims resulting from content you supply. ICT Cart has the right but not the obligation to monitor and edit or remove any activity or content. ICT Cart takes no responsibility and assumes no liability for any content posted by you or any third party.

NOTICE OF COPYRIGHT INFRINGEMENT

If you have any complaints with respect to the infringement of your copyright, we request that you provide the following information along with your complaint:

ü A physical or electronic signature of the person authorized to act on behalf of the owner of the copyrighted work for the purposes of the complaint.

ü A proper description of the copyrighted work claimed to have been infringed.

ü A description of the location of the infringing material on our Website.

ü The address, telephone number or e-mail address of the complaining party.

ü A statement made by the complaining party that he has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or by law.

ü A statement deposed to under oath, that the information in the notice of copyright infringement is accurate, and that the complaining party is authorized to act on behalf of the copyright owner.

Please note that this procedure is exclusively for notifying ICT Cart that your copyrighted material has been infringed. The above information should be sent to complaints@ictcart.com or to our physical address, whereupon we will immediately discontinue the use of such materials.

FORMATION OF CONTRACT

Both parties agree that browsing the site and gathering information regarding the services provided by the seller does not constitute an offer to sell, but merely an invitation to treat. The parties accept that an offer is only made once you have selected the item you intend to purchase, chosen your preferred payment method, proceeded to the checkout and completed the checkout process.

Both parties agree that the acceptance of the offer is not made when the seller contacts you by phone or by email to confirm that the order has been placed online. Your offer is only accepted when we dispatch the product to you and inform you either by email or by phone of the dispatch of your ordered product.

Before your order is confirmed, you may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order. Please note that there are cases when an order cannot be processed for various reasons. The Site reserves the right to refuse or cancel any order for any reason at any given time.

ADDING PRODUCTS TO YOUR SHOPPING CART

Register on ictcart.com shopping cart by providing ONLY genuine information, as such information may be needed to identify you or better serve you. Click on the product you are interested in, to open the product page. Click on add to cart to add the product to your shopping cart. A quick view of your shopping cart is displayed. You can continue browsing and can add more products to your cart or you can check out {i.e. proceed to pay for the product(s)} by clicking the Checkout tab.

CANCELLATION OF ORDER

ICT Cart Limited reserves the right to cancel your order without any explanation for such cancellation, under situation where ICT Cart is not able to meet the requirement of the order placed or the order so placed/cancelled does not comply with her policy or for any other reason. However, we will ensure that communication of cancellation of an order is initiated within appropriate time to the concerned customer and any applicable refund, will be made in reasonable time. 

RISK OF LOSS

All purchases of physical items from ICT Cart are made pursuant to a shipment contract.  This means that the Risk of Loss shall remain with ictcart.com until the item is transferred to you. In the event that the items are transferred, the risk falls on the validated consignee, recipient or customer.

PRODUCT AND SERVICE DESCRIPTION

ictcart.com tries to be as accurate as possible. However, we do not warrant that product or service description or other content of this site is 100% accurate, complete, reliable, current, or error-free. If a product or service offered on ictcart.com is not as described, your sole remedy is to return it in an unused condition with the product box unbroken/ seal unbroken.

RETURN/REFUND POLICY

If you are not 100% satisfied with the product you purchased due to a manufacturer's defect on the product, you can return the product for a full refund, in which case refund will be sent to the account from which the payment was made, within 5 - 7 working days. However, if you provided ICT Cart Limited your bank details during registration, a full refund would be done to your registered bank account within 24 hours; from the time your refund was approved.

On the other hand, you may exchange defective products for a new product (same model) or similar product of the same cost. You can return or exchange defective products purchased within 5 working days from the delivery date. 

Returned or exchanged products must be in the condition you received them and in the original box and/or packaging.

“PLEASE KINDLY NOTE THAT OUR RETURN/REFUND POLICY DOES NOT COVER FRAUDULENT INCENTIVES. HENCE, CUSTOMERS CANNOT HIDE UNDER THIS POLICY TO PERPETUATE FRAUD OR FOR FRIVOLOUS REASONS.

PRICING/TYPOGRAPHICAL ERROR

If ictcart.com comes across any difference in pricing resulting from typographic errors with regards to pricing or product information, ictcart.com shall have the right to rectify the same or cancel the order(s) and refund monies, if any, collected from the customer within 5-7 working days. The mode of refund will be the same as at the time of placing the order. Cash on Delivery order refunds will be done via bank transfer in the name of the registered customer. PLEASE NOTE THAT ALL CASH ON DELIVERY CUSTOMERS SHOULD REGISTER THEIR REAL NAMES TO AVOID ISSUES OF IDENTITY.

PAYMENT

While availing any of the payment methods offered at ictcart.com, ictcart.com will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to: 

a)    Lack of authorization for any transaction/s, or

b)    Exceeding the preset limit mutually agreed by you and between your "Bank/s", or

c)    Any payment issues arising out of the transaction.

All payments made against the purchases/services on ictcart.com by you shall be compulsorily in Nigerian Naira acceptable by the Central Bank of Nigeria. However, for international purchases, the US Dollar shall be acceptable.

USE OF VOUCHER CODES

Our Site accepts the use of voucher codes for orders placed online. The marketing voucher codes which are accepted on our Site entitle you at the time of ordering a product to a saving on the order being placed on the Site. Vouchers may also be issued to customers in exchange for advance payments made to us via transfer to our bank accounts for products intended to be purchased on the Site. Our voucher codes may not be exchanged for cash. However, for special offers involving wishlist, the benefactor of the wishlist can request for the cash equivalent of his/her voucher. BUT THIS WOULD ATTRACT A 20% CHARGE. NOTWITHSTANDING, ICT CART RESERVES THE EXCLUSIVE RIGHT TO ACCEPT OR REJECT ANY REQUEST TO PAY ANY CASH REFUND FOR A VOUCHER. With the exception of vouchers issued in accordance with our refunds policy and vouchers issued in exchange for advance payments, we reserve the right to cancel or withdraw our voucher codes at any time.

LIABILITY OF PARTIES ON THE ICT CART MARKETPLACE

We also operate a marketplace which is open for third-parties to sell their products on our website (the marketplace is run on ictcart.com). Products listed on the ICT Cart Marketplace by other sellers are not owned by us. Seller I.D will usually be indicated on our marketplace to show products that are not directly owned by ICT Cart. The buyer and seller agree that we would be held free from any liability in contract, pre-contract or other representations in tort, for all transactions conducted outside the ICT Cart Marketplace.

BREACH

Without limiting other remedies, ictcart.com may limit your activity, immediately remove your information, warn other users of your actions, immediately temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide you with access to ictcart.com website in the event, but not limited to:

a)    If you breach the Terms of Use or Privacy Policy or other rules and  policies, if any;

b)    If ictcart.com is unable to verify or authenticate any information you provide; or

c)    If it is believed that your actions may cause legal liability for you, other Users or ictcart.com. ictcart.com may at any time at its sole discretion reinstate suspended users. 

A user that has been suspended or blocked may not register or attempt to register with ictcart.com or use ictcart.com website in any manner whatsoever until such user is reinstated by ictcart.com. Notwithstanding the foregoing, if you breach the Terms of Use or Privacy Policy or other rules and policies, ictcart.com reserves the right to recover any amounts due and owing by you to ictcart.com and to take strict legal action including but not limited to a referral to the appropriate authorities.

INDEMNITY

You shall indemnify and hold harmless ictcart.com, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including attorneys' fees, made by you or any third party or penalty imposed due to or arising out of your use of the goods or services, or in the event you breach this Terms of Use, the Privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights of a third party on ictcart.com
